Pennsylvania Attorney General Assurances of Voluntary Compliance Files

The files below are Assurances of Voluntary Compliance (“AVC”) from the Pennsylvania Attorney General’s office.  Regional Housing Legal Services received these files in response to a Right To Know Request in early 2012.

The AVC are agreements entered into between manufactured home community owners and the Pennsylvania Attorney General’s office.  Only one file has been modified by RHLS – it has been redacted to remove homeowner contact information such as names, addresses, and phone numbers.

1. Issues: Important notice required by law, posting, sales commissions, entrance and exit fees, access to tradesmen. 
3. 1980_10_14 Pa v Eastern Dawn MHP et al
1. Issue: Right to sell home in place.
4. 1982_7_13 Dowells Mobile Home Park
1. Issues: Unfair and unreasonable rules and regulations, failure to disclose fees, removing personal property without notice, security deposits.
5. 1982_11_17 Witko Mobile Home Park
1. Issue: Choice of vendor.
6. 1983_4_28 Pa v Strause
1. Issue: Posting, arbitrarily raising rent, evicting without stating grounds for eviction and evicting tenants for exercising their rights.
7. 1986_8_20 Lee Williams – Richland Meadows
1. Issue: Arbitrary rules and regulations, right to sell home in place.

1. Issues: Important notice required by law, posting, failure to notify of rent increases, improper eviction.

1. Issues: Unreasonable rules regarding selling home in place, commissions on the sales of homes without the proper licenses, posting, security deposits.

1. Issue: Commission for selling a home, arbitrary rules. 
14. 1995_10_9 Pa v Perano – Country Manor West
1. Issue: Interfering with the right to sell the home in place.
15. 1996_11_5 PA v Martin – Maples MHP
1. Issues: Unreasonable rules regarding pets and unoccupied homes.
16. 1997_7_2 Pa v Chesapeake Estates of Grantville
1. Issues: Unreasonable rules regarding rent charged for number of people in home and exit fees.
17. 1998_3_4 PA v Coulter
1. Issues: Failure to post important notice required by law, unreasonable rules regarding rent charged for visitors, confession of judgment clause, excessive interest disallowed by the Motor Vehicle Sales Finance Act.
2. Note:  This file also include a 1989 case against the same Community Owner, regarding selling and financing homes.

1. Issue: Modification of the important notice required by law.

1. Issues: Consumer Protection Law and communications regarding the reason for a rent increase, unreasonable rules, confession of judgment clause.
